These Terms of Use ("Terms") govern your use of Chart Alpha, a mobile application developed and operated by Code & Love, LLC ("we", "us", or "our"). By accessing or using Chart Alpha, you agree to be bound by these Terms. If you do not agree, do not use the app.
You must be at least 13 years of age to use Chart Alpha. If you are under 18, you must have permission from a parent or legal guardian. By using the app, you confirm that you meet these requirements.
Chart Alpha is a stock chart trading simulator for educational and entertainment purposes only. The app uses historical market data to simulate trading scenarios. It does not involve real money, real financial transactions, or real trading of any kind. Simulated results do not guarantee real-world trading performance.
Chart Alpha is not a financial advisor. Nothing in the app constitutes investment advice, financial guidance, or a recommendation to buy or sell securities. Past performance of simulated trades does not predict future results. Always consult a licensed financial professional before making investment decisions.
We grant you a limited, non-exclusive, non-transferable, revocable license to use Chart Alpha for personal, non-commercial purposes on any Apple-branded Products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. You may not copy, distribute, sublicense, or create derivative works from the app or its content.
Chart Alpha uses third-party services including Google Firebase (analytics) and Google AdMob (advertising for free-tier users). These services may collect anonymous usage data as described in our Privacy Policy. We are not responsible for the content or practices of third-party services, and you interact with them at your own risk.
All content in Chart Alpha — including design, code, graphics, and text — is the property of Code & Love, LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Your data is stored locally on your device. We collect anonymous analytics data as described in our Privacy Policy. If you wish to delete all app data, you can uninstall the app from your device, which will remove all locally stored data. For any data deletion requests related to analytics, please contact us at chartalpha@codeand.love.
CHART ALPHA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODE & LOVE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO FINANCIAL LOSSES FROM REAL-WORLD TRADING DECISIONS INFLUENCED BY THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US FOR ACCESS TO THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Code & Love, LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your violation of these Terms of Use, your violation of any applicable laws or regulations, or your misuse of the Chart Alpha app.
These Terms shall be governed by and construed in accordance with the laws of the State of South Dakota, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in South Dakota.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
When using Chart Alpha, you must comply with all applicable third-party terms of agreement, including your mobile carrier's terms of service, your internet service provider's terms, and any other agreements governing your use of devices or services in connection with the app.
We reserve the right to modify these Terms of Use at any time. Continued use of the app after changes constitutes acceptance of the updated terms.

If you downloaded Chart Alpha from the Apple App Store, the following terms apply:
Acknowledgment: You and Code & Love, LLC acknowledge that these Terms are concluded between you and us only, and not with Apple. Code & Love, LLC, not Apple, is solely responsible for the app and its content.
Maintenance and Support: Code & Love, LLC is solely responsible for providing any maintenance and support services with respect to the app. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.
Warranty: Code & Love, LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
Product Claims: We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app, including but not limited to: (i) product liability claims, (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
Intellectual Property Rights: In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, Code & Love, LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Third-Party Beneficiary: You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
